1. Scope
These General Terms and Conditions (GTC) apply to all contracts concluded between Vantastore GmbH, [address], Hamburg, Germany ("Vantastore", "we") and a consumer or business customer ("you") via vantastore.io. A consumer is any natural person who enters into the contract for a purpose that is predominantly outside their trade, business or profession (§ 13 BGB / Art. 2 (1) Directive 2011/83/EU). For customers in Georgia, the Law of Georgia on Protection of Consumer Rights (No. 885-VI, 2022) applies in addition to these terms.
2. Conclusion of contract
Product presentations on our website are an invitation to treat, not a binding offer. By clicking "Complete order" you submit a binding offer. We accept your offer by sending an order confirmation email that also confirms shipment. Contract languages: English and German.
3. Prices and payment
All prices are shown in the currency displayed at checkout and include statutory VAT. Shipping costs, where applicable, are stated separately before you complete your order. Payment is processed via Shopify Payments and the payment methods offered at checkout.
4. Delivery
We ship to EU/EEA member states, Switzerland, the United Kingdom and Georgia. Estimated delivery times are shown on the product page and in the order confirmation. Risk of loss passes to consumers only upon actual receipt of the goods (§ 475 (2) BGB / Art. 20 Directive 2011/83/EU).
5. Right of withdrawal
Consumers have a statutory right to withdraw from the contract within 14 days without giving any reason. Full instructions and the model withdrawal form are provided on our Right of Withdrawal page. Customers in Georgia are entitled to the same 14-day withdrawal right under Article 13 of the Law of Georgia on Protection of Consumer Rights.
6. Statutory warranty
The statutory rules on liability for defects apply (§§ 434 ff. BGB; Directive (EU) 2019/771). The warranty period for consumers is two years from delivery. Nothing in these terms excludes or limits your non-waivable statutory rights.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (ProdHaftG). For slight negligence we are only liable in the event of a breach of a material contractual obligation, and only up to the foreseeable damage typical of the contract.
8. Dispute resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
9. Applicable law
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence (Art. 6 (2) Rome I Regulation).
